This week, Governor Ron DeSantis signed HB 621, which protects property rights, provides homeowners remedies against squatting, and increases penalties on squatters.
This is very similar Chapter 82 of the Florida Statues, a law which has been on the books for several years. Chapter 82 provides the outline of an affidavit which the property owner or property manager may present to Law Enforcement when person(s) unknown to them have taken up occupancy (squatters). The problem we had with enforcement of Chapter 82 was many deputies were uneasy about forcibly removing people from a residence when the two parties disagree about the residents right to occupy. Most of the time they would declare it a Civil matter which must be decided by a Judge. Such and eviction could take several weeks, while the resident has free access to the property and in many cases, deliberately damages it.
The new law, which takes effect July 1, 2024 is very similar and provides a very similar affidavit which the property owner or manager is to complete and present to Law Enforcement. The difference now is the very public involvement and support of no less than the Governor. This means sheriff deputies may be much more likely to physically remove such residents. Awesome!
