Berea City Council considers changes to landlord compliance ordinance

BEREA, Ohio -- Berea City Council is studying an amendment to a 2005 ordinance that would require landlords to submit a notarized affidavit certifying compliance with all safety regulations in lieu of a city inspection.  Landlords would submit the affidavit along with their required leasing permit applications.

When City Council held discussions Jan. 22, Ward 3 Councilman Jim Maxwell expressed concerns about placing "an undue burden on the landlord."

"The application shall be made under oath and shall include a certificate of compliance with the provisions of the housing code, the names and number of prospective tenants, renters or regular occupants and the number of motor vehicles regularly used by such persons," the proposed amendment indicates.

Required vehicle information includes a license plate number for each person residing in the dwelling.

Mayor Cyril Kleem assured Maxwell that police officers would use it simply to ascertain compliance with state safety laws regarding the allowable maximum number of tenants.  Read More
